Do not expect your Councillor will be happy to see you asking for a BP-11 Form. Expect retaliation, understand the importance of the Bureau of Prisons Administrative Remedy filing deadlines, and be prepared for the BOP not to play fair.
YOU MUST COMPLETE YOUR ADMINISTRATIVE REMEDIES BEFORE FILING IN COURT!!!
Rule:
* BP-11 (General Counsel Level): For appeals submitted to the General Counsel, the expected response time is 40 calendar days, with a potential for an additional 20-day extension. If the response period expires without a response, this too is deemed a denial.
* You MUST include the denial of your BP-8 and denial of your BP-9, and the denial of your BP-10 with four (4) additional copies of with all exhibits.
* Make sure to Mail it in a USPS Flat Rate Envelope with the FREE Tracking Label, so you can verify the date it was received. That is the date the clock begins on the due dates.
* Keep it simple and straightforward: "I am appealing the denial of my BP-11 Request, I have attached my BP-8 denial (Exhibit #1) and my BP-9 denial (Exhibit #2), and my BP-10 denial (Exhibit #3) with four copies in a timely manner, requesting all my First Step Act Earned Time Credits, which I am entitled to, to be applied to sentence without further delay."
* The moment you put that BP-11 in the mail, you have now satisfied your Administrative Remedy and can file directly to court via a 2241 Petition, requesting all my First Step Act Earned Time Credits, which I am entitled to, to be applied to sentence without further delay
* The BOP has a tendency to attempt to return Administrative Remedy paperwork beyond the due date for you to proceed to the next step, as a delay tactic. Whomever delivers this to you make sure they initial and date it, to cover yourself, when they argue you answered late.
* If you do not stay on top of your due dates for your Administrative Remedies you will waste time and have to start over.
