Do not expect your Councillor will be happy to see you asking for a BP-8 Form. Expect retaliation, understand the importance of the Bureau of Prisons Administrative Remedy filing deadlines, and be prepared for the BOP not to play fair.
YOU MUST COMPLETE YOUR ADMINISTRATIVE REMEDIES BEFORE FILING IN COURT!!!
Rule:
* BP-8 (Informal Resolution Level): Before filing a formal complaint, inmates are encouraged to seek informal resolution, by submitting a BP-8 form, they should expect a response from the counselor within seven (7) calendar days.
* Simplicity in preparing the BP-8 is to your advantage.
* A simple one sentence request is all you need. In most of the successful cases throughout the United States, the Petitioner, requested at every level the same relief they would eventually ask the court. "I am requesting all my First Step Act Earned Time Credits, which I am entitled to, to be applied to sentence without further delay."
* On Day 8, request a BP-9, whether or not they responded to your BP-8 request or even retaliated against you and placed you in Solitary Confinement.
* In the event they return the BP-8 to you make sure the date it is given you matches the date on the response. The BOP has a tendency to attempt to return Administrative Remedy denial paperwork beyond the due date for you to proceed to the next step, as a delay tactic. Whomever delivers this to you make sure they initial and date it, to cover yourself, when they argue you answered late.
* If you do not stay on top of your due dates for your Administrative Remedies you will waste time and have to start over.
